Open Question: Parent has been absent 5 years - what are his rights if he shows up now?

December 10th, 2008 | by admin | Open Question: Parent has been absent 5 years - what are his rights if he shows up now?
My sons father and I were not married and he was well aware that my son was on the way. He saw him his first 2 months of life, and aside from several acts of violence that are suspected of being committed on his behalf has had no contact in the past 5 years.
My questions is this - he is not on the birth certificate, has nothing to do with my son and has made no effort to have any part of his life. To the contrary, he has said he wants nothing to do with children and has likened a child to AIDS in writing. He has never paid any money, nor do I want his money.
If he ever showed up, what would he get for visitation right? Would a judge just hand my son over to him for visitation? Would he have to go to parenting classes? My son also has life threatening allergies to food and environmental triggers, asthma and a heart murmur.
My sons father has a brother who is a chronic drug addict and has been recently arrested for aiding and abetting, larceny, kidnapping, drug posession, posession of paraphanalia, and grand theft. His father has kept his record clean for 5 years, but had 2 DUI’s in the past.
It might not happen, but I just wonder how the courts view situations where a parent knows the child is there and has been absent by choice.
Please help a worried Mommy of one secure, confident, happy little boy.
